Professional or employment-related information, including the business or organization an individual represents, their title, and information related to their role.

Sensitive Personal Information, including social security number, driver’s license or other government identification, precise geolocation data, and account login credentials. Each type of Sensitive Personal Information may also fall under another category of personal information listed above.

By providing your phone number, email address, or other contact information to Sunwise Energy LLC or its shared partners — including Sundra — you consent to be contacted by email, phone calls, and SMS/text messages. Communications may include quotes, appointment scheduling, project updates, installation notices, service notifications, customer support, and promotional or informational messages related to your project or our services. Message frequency may vary, and standard message and data rates may apply.


2. HOW WE COLLECT INFORMATION

We collect information through several methods: (A) information you provide to us directly; (B) information we automatically collect; and (C) information we receive from third parties. This includes data that identifies you personally, whether directly (e.g., your name) or indirectly (e.g., information about your online behavior).

A. Information You Provide to Us

We may collect personal information directly from you when you provide it through the Sites or Services — for example, when you register or create an account, request a quote or consultation, sign up for our email list, fill out a survey, request customer support, or otherwise communicate with us. We also collect information submitted through website forms, chat interactions (AI and live agent), phone calls, inbound inquiries, and advertising platforms such as Meta and TikTok lead forms.

A. General Use by Sunwise Energy

We also use your information to contact you by phone, email, and SMS/text message for purposes such as providing quotes, scheduling appointments, sending project updates, and sharing promotional offers related to our services, consistent with your communication preferences and applicable law.

We use Sensitive Personal Information to provide goods or services you have requested, to deliver customized content, to perform credit checks and process payments, and to assess the suitability of your home for a solar system.

B. Interest-Based Advertising

In connection with a sale or transfer of our business or assets, in which case your information may be transferred as part of that transaction. To comply with applicable law, including in response to court orders, subpoenas, or government regulatory requests. To enforce our rights or protect the safety and security of our Sites, systems, and customers. In aggregated or de-identified form with third parties for marketing or analytics purposes.

Sunwise Energy does not sell personal information to unrelated third parties for their own independent marketing purposes. Any partner receiving your information is required to use it solely for the purpose of providing the requested services, maintain reasonable privacy and security practices, and comply with applicable laws, including all communication, email, and SMS/text messaging regulations.


5. COMMUNICATION & SMS MESSAGING

By submitting your information through our website, forms, or lead capture tools, or by otherwise providing your mobile phone number to Sunwise Energy, you agree that Sunwise Energy may contact you by phone, email, and SMS or text message for purposes such as providing quotes, appointment reminders, scheduling confirmations, project updates, follow-ups, and promotional offers related to our services. These messages may occasionally include information about trusted partners that support solar system evaluation, installation, financing options, or other services related to your project.

Standard message and data rates may apply, and message frequency may vary based on communication needs. You may opt out of SMS messages at any time by replying STOP. For help, reply HELP. Your choice to opt out of SMS marketing will not affect transactional or project-related communications necessary to complete work you have requested.

Consent to receive SMS or text messages is not required to obtain a quote, estimate, or any Sunwise Energy product or service. Sunwise Energy does not charge for SMS messages, but your mobile carrier’s message and data rates may apply.


6. YOUR CHOICES & OPTING OUT

A. Cookies and Tracking Technologies

You may adjust your device or browser settings to limit certain tracking or decline cookies. Doing so may affect your ability to use certain features of the Sites. Our Sites may not recognize “do not track” signals from all browsers.

B. Interest-Based Advertising

8. NOTICE OF ACCESSING, COLLECTING, STORING, USING AND DISCLOSING ENERGY USAGE INFORMATION

To standardize rules regarding customer privacy, the California Public Utilities Commission has issued “Rules Regarding Privacy and Security Protections for Energy Usage Data.” These rules allow us to disclose information about a customer to a third party without consent as necessary to provide or bill for electrical power services; to comply with state or federal law or orders of the California Public Utilities Commission; to plan, implement, or evaluate energy management, demand response, or energy efficiency programs (to opt out of this purpose, please email us at info@sunwiseusa.com); to respond to lawful warrants or court orders; and to provide personal information to emergency responders in situations involving an imminent threat to life or property.


9. THIRD-PARTY LINKS AND PLUG-INS

Our Sites may contain links to third-party websites. We are not responsible for the privacy practices or content of those sites. The Sites may also offer social plugins from social media platforms, which may allow those platforms to collect data from or about you. Your use of social plugins is subject to each social media site’s own privacy policy.


10. CHILDREN’S PRIVACY

Our services are not intended for individuals under the age of 13, and we do not knowingly collect information from children under 13. We do not sell the personal information of consumers we know to be under the age of 16 without the required affirmative authorization.


11. DATA SECURITY

We have implemented reasonable measures designed to protect your information from accidental loss and unauthorized access, use, alteration, and disclosure. These measures include SSL website encryption, restricted employee access to data, and secure systems with authentication safeguards. Our services are primarily intended for customers located in New Jersey, Pennsylvania, and Delaware.

In the last 12 months, we sold, shared, or disclosed for targeted advertising purposes the following categories of personal information: Identifiers, Commercial information, Internet or other electronic network activity information, and Geolocation data, to Business and Marketing Partners, Online Advertising Networks, Social Networks, Analytics Providers, and Demand Response Programs.
